Consuelo Madrigal Martínez-Pereda, ingresó en la Carrera Fiscal hace más de treinta años, tras hacerse cargo de la Fiscalía de Menores fue fiscal destinada en la Sala de lo Penal del Tribunal Supremo, todo ello compaginado con su labor docente como profesora de Derecho en Icade desde 1986.
El procedimiento para el nombramiento de Madrigal como nueva fiscal general del Estado ha sido explicado públicamente por José Luis Ayllón, secretario de Estado de Relaciones con las Cortes.
En primer lugar, el Gobierno propondrá su candidatura en el Consejo de Ministros, donde deberá ser aprobada.
En segundo lugar, está previsto que se convoque un pleno extraordinario del Consejo General del Poder Judicial para el próximo lunes quien deberá ratificar su nombramiento.
Finalmente, el Gobierno comunicará su propuesta al Congreso de los Diputados, a fin de que la nueva fiscal general pueda comparecer ante la Comisión de Justicia de la Cámara. Además, será necesario que se emita un informe de idoneidad, en el que se confirmará que cumple con los requisitos exigidos por la ley para acceder al cargo.
Cumplidos esos trámites, se le comunicará al rey Felipe VI la elección de Consuelo Madrigal como primera mujer fiscal general del Estado.
